Minutes of a Special Village Board Meeting

(To approve 2017 Budget and consider action on adjourned Conditional Use Permit request by L & L Propane)

Trustees of the Villageof Brandon, Fond du Lac County, Wisconsinmet in the Village of Brandon Board Room on Monday, November 30, 2016 at 6:00 pm.   


President Dave Tarr called the meeting to order at 6:01 p.m. and presided.  Clerk Vande Zande recorded the minutes of the hearing.


The roll was called and the following trustees were present: Shaun Hiemstra, Angie Smit, Kurt Krohn, Gwen Shoffner, Richard Vollbrechtand Michael Walgenbach. 


Also present in the audience was Police Chief, Tom Dornbrook; Village Attorney, Lud Wurtz; Craig Bresser, Melvin Gunnink, Robert Newton, Luke Lauritzen, Mike Lauritzen, Joel VandenBerg.


Budget hearing: No public comment regarding the 2017 budget, President Tarr closed the public hearing at 6:06 p.m.


Motion by Tarr/Krohn, unanimously carried on a roll call vote, to approve the 2017 budget as presented (note: Village levy $319,744).


Attorney Wurtz reported a public hearing on the Conditional Use Permit request by L & L Propane was held at the October 10, 2016 Village Board meeting.  A motion was made at the November 14, 2016 meeting to approve the request, however, the motion failed due to tie vote (3 ayes, 3 nays).  We are here to discuss the request one more time, with a full board present.  Several letters and pieces of information have been given to the Clerk which she passed on to each Board member by email.


Safety concerns were once again discussed.  While the issue of safety is always a concern, information provided to the Board suggest there are many regulations in place for propane storage facilities and safety issues are minimal.


The Board also discussed if this was the right location for a propane storage facility.  Walgenbach discussed how he felt this property, located in the TIF district, was better served with a “structure”.  While Tarr would like to see revenue from a new business in the Village, he feels the issue of compatibility needs to be considered.






Motion by Krohn/Shoffner to approve the conditional use request by L & L Propane with all the conditions discussed at the November 14, 2016 meeting as well as the addition of crash protection.  Screening plan approved by building inspector to be brought back to the Board for final approval.  Motion failed with Aye votes from Krohn, Shoffner and Nay votes from Hiemstra, Smit, Tarr, Vollbrecht, Walgenbach.  Motion was rejected based upon the fact the conditional use request failed to meet the standards under: 485-30(A)(1)(b) (The uses, values and enjoyment of other property in the neighborhood for purposes already permitted shall be in no foreseeable manner substantially impaired or diminished by the establishment, maintenance or operation of the conditional use and the proposed use is compatible with the use of adjacent land) and 485-30(B)(5) (Its compatibility with uses on adjacent land).


6:50 p.m. on a motion by Hiemstra/Krohn, unanimously carried, to adjourn.
