Monthly Board Meeting Minutes

Monday, June 12, 2017

 

Trustees of the Villageof Brandon, Fond du Lac County, Wisconsin met in the Village of Brandon Board Room on Monday, June 12, 2017 at 7:30 p.m.   

 

President David Tarr called the meeting to order and presided.  Clerk Corinne Vande Zande recorded the minutes of the meeting.

 

The following trustees were present:  Shaun Hiemstra, Kurt Krohn, Gwen Shoffner, Richard Vollbrecht and Mike Walgenbach.

 

The following were present in the audience:  Director of Public Works Vance Henning, Village Attorney, Lud Wurtz, Scott Vossekuil, Craig Rasmussen, Bruce Barganz, Steve Hellenbrand, Jon Shrock, Brian Koenig and Ben Geisthardt.

 

The meeting was held by candlelight as there was a power outage due to the storm. Business discussion was limited to items needing action before the next meeting.

 

The June 2017 payments (as attached) were approved by the Board on a motion by Trustees Shoffner/Walgenbach and unanimously passed on a roll call vote.

 

The minutes of the May 8, 2017 monthly meeting were approved by the Board on a motion by Trustees Tarr/Shoffner and unanimously passed on a voice vote.

 

The minutes of the May 10, 2017 Board of Review meeting were approved by the Board on a motion by Trustees Tarr/Walgenbach and unanimously passed on a voice vote.

 

Public Hearing:

Applicant: Insight FS 

General legal description: UNPLA LAND S36 T15N R14E ALL TT PT OF N ½ OF NW ¼ AS DESC IN V225-349, Parcel #V01-15-14-36-06-160-00 

Request:  Conditional use permit request to manufacture feed in an Industrial District.

 

Public Hearing called to order at 7:30 p.m.

 

Public Comment:

Representatives from Insight FS were available to answer any questions.  It was reported they are currently producing feed out of the commodities shed.  Once the new mill is built all feed production will move there.  It has not been decided what will be done with the old mill on Main St.  There has been interest from other parties.  With the new FISBA standards there will be a new dust collection system at the new mill.  Residents of the Village will notice a significant reduction in the dust. 

 

Clerk Vande Zande reported all Board members received a memo from Village Engineer Don Neitzel of Kunkel Engineering.  Neitzel suggested contingencies the Board should include as part of the motion for the conditional use approval.  These contingencies refer to the sewer and water installation to the site.  Public Works Director Vance Henning noted the drawings given to the Village do not indicate what type of lateral will be installed and he was recently made aware that a forcemain will be installed.  Henning reported that Insight’s contractor initially stated that a gravity sewer would be installed.  Henning objects to a forcemain under the Village streets.  (See Neitzel’s memo with conditions as indicated below).

 

There were no neighbors present to express their concerns.

 

President Tarr closed the public hearing at 7:44 p.m.

 

Board Discussion & Possible Action:

On a motion by Trustees Tarr/Hiemstra, unanimously passed on a roll call vote, the Board approved a conditional use permit for Insight FS to manufacture seed in an Industrial District with the conditions set forth in Don Neitzel’s email dated June 12, 2017. Parcel #V01-15-14-36-06-160-00.  Conditions are as follows:

  • The portion of sanitary sewer lateral within the public right of way is to be gravity sewer and not forcemain.  The proposed grinder station forcemain from the new addition will be connected to the gravity sewer portion of the lateral by way of a manhole located on private property just outside of the right of way.
  • The proposed 1 ½” or 1 ¾” water service shall be constructed per the Villageof Brandon water specifications, including all hardware.  A copy of which will be provided to the contractor installing the services.
  • Bowen Street is to be restored using 12” of aggregate base course, 4” of asphalt pavement, which curb & gutter, sidewalk, and driveway approaches that are disturbed being replaced in kind as well.
  • The curb stop box (water shut off) and sanitary lateral manhole (connection point of forcemain and gravity sewer) shall be installed with concrete around the castings to ensure the tops are not plowed off or installed in such a location approved by the Village, that this will not be an issue.
  • A complete site plan be submitted showing proposed site drainage and grading, building setbacks per Village Ordinance, and revised utilities as outlined above, for final review & approval by Village Engineer.

Request:  Conditional use permit request to keep one movable frame hive box.

 

Public Hearing called to order at 7:45 p.m.

 

Public Comment:

Vance Henning spoke as a neighboring property owner.  He is allergic to bees and has grand kids that play near the hive. 

 

Ben Geisthardt inquired if there was any research showing a higher rate of bee stings near these hive boxes. 

 

President Tarr closed the public hearing at 7:50 p.m.

 

Board Discussion & Possible Action:

Action is being postponed to the July meeting when the Frank’s will be available to attend.

 

Old Business (Agenda item #1): Ben Geisthardt was in attendance to speak to the board about black topping the terrace in front of his house at his expense.  Because of safety concerns on that particular section of West Street Henning would not be opposed to this terrace and the terrace area directly to the North being paved to move parking off of the street.  Henning would like to get some estimates and bring a recommendation back to the Board.  Attorney Wurtz does not recommend allowing property owners to black top terraces but because of the safety concerns discussed he would like Henning to get a plan together and have this on the agenda next month.  Motion by Tarr/Shoffner, passed on a voice vote, to table until July meeting.

 

Audience Participation:

Scott Vossekuil was in attendance to speak to the Board about the tiling that runs through his property.  Henning noted Vossekuil would like to plant and harvest over the tiling that is on the property which Vossekuil noted is 7 feet underground.  Our agreement states there is no harvesting or planting over the tiling.  There is also a ditch on the property he would like the Village to clean out.  Using flashlights, Vossekuil and Henning pointed out these areas on a map of the property.  Attorney Wurtz would like Henning to get some numbers together and bring back to next month’s Utility meeting.

 

New Business (Agenda item #3a):  On a motion by Trustees Krohn/Vollbrecht, passed on a roll call vote, the Board approved the Class “B” Fermented Malt Beverage/”Class B” Intoxicating Liquor License for Craig Steven Becker, agent for Craig’s Bar & Grill, LLC d/b/a Mel’s Bar & Grill located at 137 E Main Street, Brandon, WI.

 

New Business (Agenda item #3b): On a motion by Trustees Krohn/Vollbrecht, passed on a roll call vote, the Board approved the Class “B” Fermented Malt Beverage/”Class B” Intoxicating Liquor License for Melissa Sue Clark, agent for The Corner Bar LLC d/b/a The Corner Bar located at 192 E Main Street, Brandon, WI.

 

New Business (Agenda item #4):  On a motion by Trustees Tarr/Walgenbach, passed on a roll call vote, the Board approved the Class “A” Fermented Malt Beverage License for Kraig Bauman, agent for Condon Oil Company d/b/a The Brandon Store located at 102 S Woodward Street, Brandon, WI.

 

New Business (Agenda item #5a):  On a motion by Trustees Tarr/Vollbrecht, passed on a voice vote, the Board approved the Cigarette and Tobacco Products License for Condon Oil Company d/b/a The Brandon Store located at 102 S Woodward Street, Brandon, WI.

 

New Business (Agenda item #5b):  On a motion by Trustees Tarr/Walgenbach, passed on a voice vote, the Board approved the Cigarette and Tobacco Products License for The Corner Bar LLC d/b/a The Corner Bar located at 192 E Main Street, Brandon, WI.

 

New Business (Agenda item #6):  On a motion by Trustees Shoffner/Hiemstra, passed on a voice vote, the Board approved Operator Licenses for the term 7/1/2017 through 6/30/2019 for Damian Lonnee, Natasha Frye, Melissa Clark, Tonya Brewington, Patricia Clark, Amber Groth, Trisha Becker, Lisa Ackerman, Tammy Becker, Theresa Witthun, Mary Fairbank, Trisha Jahns and Jeanine Jahns.

 

No other business came before the Board.  On a motion by Tarr/Hiemstra, unanimously passed on a voice vote, the Board adjourned at 8:19 p.m.
